A 2ª Câmara de Direito Criminal do Tribunal de Justiça do Estado de São Paulo manteve a condenação, de dois anos de reclusão, em regime inicial semiaberto, de um homem que estava vendendo um terreno que não lhe pertencia.
O crime cometido pelo homem foi o de estelionato, tipificado no artigo 171 do Código Penal e consiste em obter, para si ou para outrem, vantagem ilícita, em prejuízo alheio, induzindo ou mantendo alguém em erro, mediante artifício, ardil, ou qualquer outro meio fraudulento.
A vítima é uma senhora idosa, que pretendia se mudar para facilitar tratamento de saúde. O estelionatário anunciou um terreno e, ao encontrar a vítima, ofereceu um imóvel que já possuía uma casa em construção. A vítima contratou empréstimo no valor de R$20 mil para pagar a entrada, mas para sua surpresa, ao voltar ao local após a compra, deparou-se com a verdadeira dona do imóvel e foi quando descobriu ter sido vítima do golpe.
Na decisão unânime dos julgadores, salientou-se que “o crime de estelionato ficou bem caracterizado, afinal, a ‘fraude é qualquer malicioso subterfúgio para alcançar um fim ilícito’ ou ‘o engano dolosamente provocado, o malicioso induzimento em erro ou aproveitamento de preexistente erro alheio, para o fim de injusta locupletação’”.
