Segundo o Superior Tribunal de Justiça (STJ), constitui prática abusiva da empresa de telefonia a inclusão de novos serviços no plano de celular do consumidor, sem que haja prévia autorização.
No caso concreto, uma consumidora ingressou com a demanda judicial pleiteando a devolução em dobro de valores que, segundo ela, haviam sido pagos indevidamente, em razão de transferência do plano do seu celular, sem ela ter solicitado tal alteração, o que fez com que o plano ficasse com valor maior.
Estabelece o Código de Defesa do Consumidor, em seu artigo 51, inciso XII, que: “são nulas de pleno direito, entre outras, as cláusulas contratuais relativas ao fornecimento de produtos e serviços que autorizem o fornecedor a modificar unilateralmente o conteúdo ou a qualidade do contrato, após sua celebração”.
Portanto, caso o contrato celebrado preveja essa possibilidade de alteração de forma unilateral, ela será considerada nula, de acordo com o artigo acima transcrito.
