Desde o ano passado os aposentados e pensionistas que recebem beneficio pelo sistema da PETROS tem vivenciado uma crise financeira e uma verdadeira instabilidade quanto ao recebimento de seus proventos a titulo de aposentadoria e pensão, pois foi implantado o famoso “equacionamento” qual seja o desconto de uma contribuição extraordinária que pode chegar a mais de 35% (trinta e cinco) por cento de desconto mensal.
Para complicar mais a situação vivenciada por eles o imposto de renda que tem sua alíquota máxima de 27,5 % é computado a partir do valor total recebido, no entanto como fazer se a sua renda diminuiu por conta desta contribuição extraordinária?
No entendimento da Receita Federal a Contribuição extraordinária deve ser tributada sendo este o procedimento das entidades de previdência privada quando retém o imposto de renda na fonte como é verificado pelos aposentados e pensionistas.
Infelizmente resta para o beneficiário recorrer ao Poder Judiciário através da ação declaratória de inexistência de relação jurídica tributária e repetição de indébito. Procedimento que esta trazendo resultados favoráveis como podemos verificar em decisão Tribunal Regional Federal da 4ª Região, responsável pelo julgamento de demandas envolvendo o tema na Região Sul do país, o entendimento é idêntico ao defendido pelos contribuintes:
TRIBUTÁRIO. IMPOSTO DE RENDA PESSOA FÍSICA. RENDIMENTOS RECEBIDOS DE ENTIDADE DE PREVIDÊNCIA PRIVADA. DEDUÇÃO DA BASE DE CÁLCULO DAS CONTRIBUIÇÕES VERTIDAS À ENTIDADE. AFASTAMENTO DO LIMITE LEGAL DE 12%. CONTRIBUIÇÃO EXTRAORDINÁRIA. POSSIBILIDADE. 1[…].
2. Tanto a renda quanto os proventos pressupõem, necessariamente, a existência de acréscimo patrimonial. Não há renda e tampouco proventos de qualquer natureza sem acréscimo patrimonial (STF, Pleno, RE 117.887, rel. Min. Carlos Velloso, 2.1993), ou seja, sem alteração positiva do patrimônio (num determinado lapso temporal).
3. A legislação pátria – art. 11 da Lei nº 9.532/97 c/c art. 8º da Lei nº 9.250/95 – estabelece que as contribuições para as entidades de previdência privada domiciliadas no país são despesas dedutíveis da base de cálculo do imposto de renda, até o limite de 12% (doze por cento) do total dos rendimentos computados na determinação de tal base de cálculo.
4. O Superior Tribunal de Justiça já decidiu que o imposto de renda deve incidir sobre a totalidade dos rendimentos recebidos de entidades de previdência privada, admitindo-se a dedução da base de cálculo das contribuições vertidas à entidade, respeitado o limite de 12% (REsp 1354409/CE, Rel. Ministro HERMAN BENJAMIN, SEGUNDA TURMA, julgado em 17/05/2016, DJe 01/06/2016).
5. As contribuições para os planos de entidades de previdência privada objetivam, como regra, a formação de uma reserva matemática para o pagamento dos benefícios A situação dos autos mostra-se diversa, já que se discute a hipótese de contribuição extraordinária cobrada em razão dos déficits apresentados pelo plano.
6. A contribuição extraordinária é quantia que não visa à formação de reserva matemática, mas à mera recomposição da parcela que foi perdida. Em verdade, configura, por via transversa, redução temporária do benefício percebido, já que a simples redução de valores é vedada pelo art. 21, § 2º, da LC 109/2001. […].
