A 2ª Câmara Cível do Tribunal de Justiça da Bahia reconheceu falha no dever de proteção e transparência, entendendo pela reforma de decisão de primeira instância, passando a determinar que um banco interrompa os descontos no contracheque de um consumidor referentes à contratação de um cartão de crédito. Os juros das deduções mensais foram considerados abusivos.
No processo, o homem reclamou que o banco ofertou um produto sem as devidas informações. Disse que a instituição induz o consumidor a crer que se trata de um empréstimo consignado, mas que, na verdade, se trata de um cartão de saque. A empresa, então, tem descontado mensalmente do contracheque do cliente, com taxas de juros bastante acima da média da modalidade consignado.
Segundo o relator, “o perigo de dano ou de risco ao resultado útil do processo também resta demonstrado, na medida em que a parte Agravante é a parte mais vulnerável na relação travada na origem, e que continuará a ser penalizada acaso não se estanque os descontos em sua remuneração”.
Além disso, o colegiado proibiu a negativação do nome do consumidor nos cadastros de proteção ao crédito sob pena de multa diária.
