Em decisão proferida pela 3ª Turma do Superior Tribunal de Justiça (STJ), a maioria entendeu que a empresa de turismo que efetuou venda de passagem aérea não responde de forma solidária pelos danos morais sofridos por passageiro que teve uma mala extraviada.
Segundo o colegiado, a atuação da empresa que efetuou a venda da passagem se encerra com a própria venda, que ocorreu sem problema algum.
O ministro Moura Ribeiro, cujo voto prevaleceu, salientou que “a venda da passagem aérea, muito embora possa constituir antecedente necessário do dano, não representa, propriamente, uma de suas causas. O nexo de causalidade se estabelece, no caso, exclusivamente em relação à conduta da transportadora aérea”.
