O papel da imobiliária é administrar processos de aluguel de imóveis, intermediando a relação entre inquilinos e proprietários com segurança e comodidade. O principal instrumento desse trabalho é o contrato de locação, que deve ser redigido em conformidade com a Lei do Inquilinato.
A Responsabilidade da Imobiliária está prevista no Código Civil Brasileiro. O art. 422 diz que os contratantes são obrigados a agir com probidade e boa-fé, e o art. 722 complementa que, pelo contrato de corretagem, a imobiliária obriga-se a obter para o dono um ou mais negócios conforme as instruções recebidas.
Porém os proprietários podem se deparar com o oposto da boa corretagem, enfrentando problemas como atraso no repasse do aluguel e não atendimento às solicitações do locatário.
Em casos extremos, o dono do imóvel pode procurar a polícia e denunciar a empresa por apropriação indébita, amparado pelo art. 168 do Código Penal. É possível também acionar o Procon ou o Conselho Regional de Corretores de Imóveis (Creci) para denunciar a imobiliária, que normalmente propõe uma audiência de conciliação.
