Foi decidido pela Terceira Turma do Superior Tribunal de Justiça (STJ), que não é possível penhorar um imóvel residencial familiar que tenha sido oferecido como caução imobiliária em um contrato de locação.
No caso em julgamento, um aposentado atuou como caucionante em contrato estabelecido entre duas empresas locadoras de imóveis e a empresa locatária, dando como garantia um imóvel de sua propriedade.
Após serem identificados débitos relacionados ao imóvel locado, houve o ajuizamento de ação de execução contra o aposentado. Em sua defesa, afirmou que a garantia oferecida foi a caução imobiliária e o objeto da garantia era o imóvel onde residia com seus familiares.
O acórdão teve como Relatora a Ministra Nancy Andrighi que destacou em seu voto que as hipóteses de exceção à regra da impenhorabilidade do bem de família, previstas na Lei 8.009/90, são claras, não possibilitando interpretação extensiva.
A Ministra ainda apontou que, embora o TJSP tenha reconhecido a possibilidade de penhora do imóvel oferecido como caução, a penhorabilidade excepcional do bem de família só ocorre em caso de hipoteca dada em garantia de dívida própria e não de dívida de terceiro.
