Uma Arguição de Descumprimento a Preceito Fundamental (ADPF) foi proposta no Supremo Tribunal Federal pelo Partido Socialismo e Liberdade (PSOL) e de outras entidades da sociedade civil, tendo em vista que a Lei nº 14.216/2021 que suspendeu até 31 de dezembro as ordens de remoção e despejo até 31 de dezembro, apenas para imóveis urbanos, está próxima do seu fim.
O ministro Luís Roberto Barroso fez um apelo ao Congresso Nacional pela prorrogação da lei. Contudo, caso isso não ocorra, já estabeleceu que fica prorrogada a suspensão das ordens de despejo e desocupação.
Ressaltou que “com a chegada do mês de dezembro, constata-se que a pandemia ainda não chegou ao fim e o contexto internacional – notadamente com a nova onda na Europa e o surgimento de uma nova variante na África – recomenda especial cautela por parte das autoridades públicas”.
Ainda, destacou que não ter justificativa para a mencionada lei proteger somente as pessoas em situação de vulnerabilidade de áreas urbanas e não as de área rural, o que seria desproporcional, devendo esta lacuna ser corrigida judicialmente.
