O Fundo de Garantia por Tempo de Serviço (FGTS) foi criado no ano de 1967 com o objetivo de proteger o empregado dispensado sem justa causa. Ele é constituído de uma conta vinculada, aberta em nome do trabalhador na Caixa Econômica Federal, onde o empregador deve depositar mensalmente a quantia de 8% (oito por cento) do salário bruto pago ao empregado.
O saldo da conta do FGTS é formado por esses depósitos mensais com acréscimo de juros e correção monetária.
Contudo, desde janeiro de 1999, o índice que corrige o FGTS (chamado de taxa referencial) não acompanha os índices da inflação, fazendo com que os depósitos realizados na conta vinculada do trabalhador percam seu poder de compra.
Assim, a ação de revisão do FGTS visa justamente corrigir monetariamente os valores depositados na conta vinculada utilizando índices que refletem a inflação, como o IPCA ou INPC.
É importante mencionar que o Supremo Tribunal Federal irá julgar a constitucionalidade da ação para revisão do uso da Taxa TR para correção monetária do FGTS, em data ainda não definida.
