Nesse sentido, o Superior Tribunal de Justiça, inclusive já se posicionou a respeito, incumbindo ao poder público a responsabilidade pelo fornecimento da medicação de alto custo.
Desta maneira, segundo o tribunal, o paciente que necessitar do referido medicamento, deverá comprovar, cumulativamente:
a) a existência de um laudo fundamentado pelo médico do SUS declarando a imprescindibilidade do remédio para o tratamento da doença;
b) a hipossuficiência do paciente e;
c) que medicamento esteja devidamente registrado na Anvisa.
