Quando se trata de plano de saúde, uma das reclamações mais recorrentes é a respeito dos reajustes realizados pelas instituições. Normalmente o aumento é realizado em razão da mudança de faixa etária (após os 60 anos) ou mediante sinistro.
No entanto, verifica-se que os reajustes aplicados, na maioria dos casos, são superiores a 100%, bem como os planos, ao realizar determinada conduta, não demonstram de forma clara os parâmetros utilizados para o referido cálculo, acarretando desequilíbrio contratual e deixando os consumidores numa condição vulnerável.
Desta maneira, por não ter amparo legal, a referida prática é interpretada como abusiva. Nestas situações, segundo o artigo 6º, inciso V do Código de Defesa do Consumidor é possível a modificação das cláusulas contratuais que estabeleçam prestações desproporcionais.
No mais, conforme inteligência do artigo 51, inciso IV, desta mesma lei, devido às cláusulas contratuais colocarem o consumidor em grande desvantagem, estas são consideradas nulas de pleno direito.
Neste sentido, uma vez constatado o aumento abusivo, o plano de saúde deve diminuir a mensalidade, assim como reembolsar dos valores que foram pagos à maior.
