Com o falecimento do titular do plano de saúde, seus dependentes podem não saber se têm ou não direito de continuar no plano e garantir um atendimento médico em um momento emergencial.
Presente em alguns contratos de planos de saúde, a chamada cláusula de remissão garante o direito de permanência dos dependentes no plano em caso de morte do titular. O período de remissão é definido por cada Operadora. Pode variar entre 1 a 5 anos e, durante esse período, os dependentes ficam dispensados do pagamento das mensalidades.
Caso o contrato não tenha uma cláusula de remissão, uma normativa da Agência Nacional de Saúde Suplementar que passa a valer ao final da remissão ou em caso de morte do titular em contratos sem remissão, permite que o dependente continue com o plano desde que assuma o pagamento das parcelas.
Para que possa se beneficiar da normativa, a ANS esclarece que o dependente do plano deve comunicar a morte do titular à operadora, mesmo que o plano seja coletivo.
