O contrato é feito entre o interessado e a instituição financeira, que fornece o valor solicitado e passa a ter a propriedade imobiliária como garantia de pagamento em casos de inadimplência.
Em um processo envolvendo uma instituição financeira e uma pessoa física, a 2ª Câmara Cível do Tribunal de Justiça do Acre decidiu aceitar um pedido de cancelamento de hipoteca.
Na situação mencionada a pessoa física adquiriu um terreno e com o objetivo de garantir seu financiamento, o hipotecou. No contrato celebrado entre as partes consta que a hipoteca deveria ser cancelada com a conclusão da obra e pagamento dos valores.
A instituição financeira insistiu pela manutenção da hipoteca alegando que a construtora estava inadimplente. Contudo, o relator do processo entendeu que o “comprador da unidade habitacional somente é responsável pelo pagamento integral da dívida relativa ao imóvel que adquiriu, não podendo sofrer constrição patrimonial em razão de inadimplemento da construtora”.
