Para o ministro, a Lei 8.009/90 (que dispõe sobre a impenhorabilidade do bem de família) não fez distinção entre locação residencial e comercial para fins de excepcionar a impenhorabilidade do bem de família do fiador. Em outras palavras, decidiu que é possível a penhora, independentemente da locação residencial ou comercial.
