Em julgamento realizado pela 6ª Vara Cível do Tribunal de Justiça do Rio de Janeiro, uma instituição bancária foi condenada a deixar de cobrar juros de cartão de crédito em um contrato de empréstimo consignado com descontos na folha de pagamento.
Segundo o consumidor, ele contratou empréstimo, mas foi surpreendido com o fato de que, na verdade, tratava-se de empréstimo na modalidade de cartão de crédito, sendo descontado no seu contracheque somente o valor mínimo da fatura.
O magistrado considerou que, em casos como esse, a conduta das instituições financeiras é desprovida de boa-fé, vez que o consumidor buscava empréstimo com descontos em folha de pagamento e não aquisição de cartão de crédito, muito menos com um empréstimo vinculado a esse cartão.
Sendo assim, ficou determinada a alteração da cláusula de juros do contrato, devendo ser cobrado os juros e encargos médios do crédito consignado em folha, em substituição aos do cartão.
