Conforme decisão proferida pelo Supremo Tribunal Federal na ADI nº 5422, valores recebidos a título de pensão alimentícia não são mais tributados pelo Imposto de Renda (IR).
Sendo assim, a Receita Federal esclareceu que os contribuintes que, nos últimos 5 anos (2018 a 2022) apresentaram declaração, incluindo esse valor como um rendimento tributável, podem retificar a declaração e fazer o acerto.
A declaração retificadora deve ser preenchida da seguinte forma: “O valor de pensão alimentícia declarado como imposto tributável deve ser excluído e informado na opção ‘Rendimentos Isentos e Não Tributáveis/Outros’, especificando ‘Pensão Alimentícia’”. As demais informações sobre o imposto pago ou retido na fonte devem ser mantidas.
✅Imposto a restituir: Se, após você retificar a declaração, o saldo de imposto a restituir for superior ao da declaração original, a diferença será disponibilizada na rede bancária, conforme cronograma de lotes e prioridades legais.
✅Imposto pago a maior: Se, após você retificar a declaração, o saldo do imposto efetivamente pago for reduzido, o valor excedente será restituído, por meio de pedido eletrônico de restituição (Perdcomp).
⚠️Atenção! Nesse caso, a restituição ou compensação do imposto pago indevidamente ou a maior deverá ser solicitada por meio do programa PER/DCOMP web (Pedido de Restituição, Ressarcimento ou Reembolso e Declaração de Compensação), disponível no Portal e-CAC, ou em alguns casos por meio do PGD Perdcomp.
