Verificado vício na construção, o consumidor tem o direito de exigir a substituição. O artigo 18, § 1º do Código de Defesa do Consumidor (CDC) garante que isso deverá ocorrer no prazo de 30 dias. Caso esse prazo não seja respeitado, o consumidor poderá escolher entre três alternativas, quais sejam, a substituição do produto por outro da mesma espécie, a restituição imediata da quantia paga ou o abatimento proporcional do preço.
O artigo 26, inciso II, do Código de Defesa do Consumidor dispõe que “o direito de reclamar pelos vícios aparentes ou de fácil constatação caduca em noventa dias, tratando-se de fornecimento de serviço e de produtos duráveis”.
Portanto, em se tratando de paredes mal pintadas, portas quebradas, rachaduras ou quaisquer outros vícios que possam ser facilmente visualizados, o consumidor terá o prazo de 90 dias para reclamação, contados da efetiva entrega do produto ou término da execução dos serviços. Entretanto, quando o síndico assina a vistoria, perde-se essa garantia.
Já o artigo 26, § 3º, também do Código de Defesa do Consumidor, trata de vícios ocultos, garantindo o início da contagem do prazo de 90 dias no momento em que fica evidenciado o defeito, como por exemplo, um problema estrutural.
Importante ressaltar que os prazos mencionados são para que o consumidor exerça o seu direito de reclamação. Caso seja necessário o ingresso com uma demanda judicial, a lei prevê o prazo de cinco anos.
