No presente caso o que se busca é justiça, pois a tributação do imposto de renda é legalizada, mas deve ser baseada na realidade do contribuinte, tendo em vista que o ativo está arcando com um prejuízo do qual não participou das decisões. Enfim, estas famílias precisam ter a justiça ao seu lado.
Portanto, a lei deve ser respeitada, ou seja, o imposto de renda deve incidir sobre renda e proventos reais e não fictícios, observando a realidade do contribuinte.
