Na ação de Despejo é possível a cobrança dos danos causados ao imóvel pelo locatário, servindo de prova o laudo de vistoria feito no momento da celebração do contrato de aluguel, bem como as imagens do imóvel após a saída do locatário.

Art. 59. Com as modificações constantes deste capítulo, as ações de despejo terão o rito ordinário.
§ 1º Conceder – se – á liminar para desocupação em quinze dias, independentemente da audiência da parte contrária e desde que prestada a caução no valor equivalente a três meses de aluguel, nas ações que tiverem por fundamento exclusivo: (…)
