Para esclarecer a pergunta, vamos para mais uma história. Pedro comprou uma casa de Maria e, no ato do pagamento, avisou que não iria fazer a transferência do imóvel para seu nome porque só tinha reservado o dinheiro da compra da casa.
Já sabe o que aconteceu, não é? Passaram-se meses e nada de Pedro ir ao Cartório para transferir o imóvel para o seu nome. Um certo dia, um Oficial de Justiça vai até a residência de Pedro com o intuito de citá-lo e informá-lo que o imóvel será levado a leilão em razão de uma dívida de Maria.
Pedro até tenta explicar que ela não é mais proprietária da casa. Muito aflito, mostra o contrato de compra e venda para o Oficial de Justiça. O problema é que Pedro terá que participar do processo em questão, pois como ele não passou a casa para o seu nome, ainda consta no Cartório de Registro de Imóveis que Maria é a proprietária.
Deixando a história um pouco de lado, esta situação é muito frequente e tudo começa com a falta de planejamento. Isso porque no momento da decisão de comprar um imóvel, seja para morar, seja para investir, é necessário incluir no cálculo as taxas cartorárias, pois a falta de registro do imóvel causa insegurança jurídica, podendo ensejar as seguintes situações:
1. Perda do imóvel em virtude de fraude contra credores, realizado pelo proprietário do imóvel. Ocorre quando o proprietário tem conhecimento de um processo judicial de execução e vende o imóvel que poderia ser levado a leilão para pagamento da dívida, restando, neste caso, ajuizar ação judicial para reaver o valor pago.
2. Participar de um processo judicial como terceiro interessado para demonstrar que a compra foi realizada de boa-fé e com as cautelas devidas, incluindo nesta questão a verificação da certidão de inteiro teor do imóvel de forma antecipada à compra.
3. E por último, a venda do imóvel pelo antigo proprietário a outra pessoa e registro imediato no Cartório em nome do novo proprietário, o que impediria o registro com o nome do primeiro comprador no Cartório de Imóveis. Imagine a confusão!
Por isso, o registro no Cartório deve ser feito imediatamente após a compra, sendo que é essencial a pesquisa sobre a situação do imóvel antes que qualquer pagamento seja efetuado. A pesquisa é de responsabilidade do comprador para evitar problemas futuros, podendo ser feito pelo próprio comprador ou com assessoria jurídica.
Não esqueça: se for comprar um imóvel, faça uma investigação prévia, calcule todos os gastos para que ao final o imóvel seja seu (posse e propriedade). Por fim, se apareceu alguma dúvida ou prefere um acompanhamento jurídico para este momento relevante em sua vida, procure um (a) advogado (a) de sua confiança.
